Will of George Petty, Deceased.:
To the Hon. H.R, Kincaid , Judge for Lane County, Oregon
Comes now, Malinda F. Petty & Riley Petty, your petitioners herein and respectfully show and aleges
That the said George Petty died in Lane County, Oregon, on the 23rd of November, 1902, of he age of about 66 years, and at the time of his death was a resident and an inhaabitant of said Lane County.
That the said George Petty at the time of his death owned and held an estate situated and being in said Lane County, consistin of real and personal property of he probaable value of about $4000.00.
That the said George Petty died in Lane County, Oregon, on the 23rd of November, 1902, of he age of about 66 years, and at the time of his death was a resident and an inhabitant of said Lane County.
That the said George Petty at the time of his death owned and held an estate situated and being in said Lane County, consisting of real and personal property of he probable value of about $4000.00.
That the said deceased in his lifetime and on the 2nd day of August in 1902, being of sound & disposing mind and Memory and of his own free will, duly and legally made and executed his last will and testament, whereby he disposed of all his said estate according to law: said will being signed by said testator in the presence of J.W. Walker and William Barnett, who signed said will at the request of the testator in his presence and in the presence of each other as attesting witnessses therto, which said last will and testament is herwith filed and presented to said court for probate.
That by and through said will the said deceased nominated and appointed as executores therof Malinda F. Petty late wife, and Riley Pett, a son of deceased and it is expressly provided in said will, that the said persons so appointed and nominated shall not be required to give bonds a such.

That the heirs, next of kin only heris at law of said George Petty deceased are the persons named in said will as follows:
Malinda F. Petty, late wife of deceased, age about 47 years, Riley Petty, a son of deceased, age about 26 years, May Petty a daughter age about 25 years, Edward Petty a son , age about 24 years, Hattie Petty a daughter, age about 23 years, John Petty, a son about 15 years, and Ethel Petty a daughter age aabout 6 years: that each and all of said hers reside and have theri post office address at Crosswell, Lane County, Oregon.
That your said petitioners are of lawful age as above stated and are competent and proper persons to act as executors of said last will and testament and of said estat: and allege that the said last will and tes tament herein -above referred to was and is the last will and testament of said George Petty, deceased, and th e same is entitled ot probate and the same is here propounded and offered for probate.

Memorial services for Ethel Zimmerman, 82, Newberg, will be held Thursday,
April 27, 1978, 2 p.m., at Newberg Methodist Church, with the Rev.
Hillis Slaymaker officiating.Private family interment will be at Yamhill-Carlton Pioneer Cemetery.
Mrs. Zimmerman died April 22, 1978, at Good Samaritan Hospital, Portland.She was born March 7, 1896, at Creswell, Ore., the daughter of George and
Malinda Eaton Petty.Surviving are a daughter, Carolyn Larson, Corte Madera, Calif., two
grandchildren, one niece and four nephews.Mrs. Zimmerman was the daughter of pioneers. George Petty, her father,
was a member of the “lost wagon train” of 1853.She was graduated from Creswell High School and in 1921; she was
graduated from Good Samaritan School of Nursing in Portland. She
returned to Lane County and subsequently became first superintendent
of nursing at Eugene Hospital.Later, she studied public health nursing at the University of Oregon
and served at the school’s infirmary.After her marriage to Peter C. Zimmerman in July 1928, she made
her home on a farm near Yamhill. Following her husband’s death in
1950, she managed the farm until her return to Eugene in 1954,
remaining there until 1967, when she became a resident at Friends
View Manor in Newberg.She was a life-long member of the Methodist Church, a member of the
Good Samaritan Alumni Association, an honorary member of Lane County
Historical Society, a member of the Oregon and Yamhill County
Historical societies, a 50-year member of Oregon State Grange and
a member of the Oregon Small Woodlands Association.Funeral Directors are Macy & Son, McMinnville. Viewing will be
Tuesday and Wednesday at the Chapel of Macy & Son. Contributions
may be made to the Arthritis Foundation in care of Macy & Son,
or the Friends View Manor Infirmary fund.

County of Lane ]SS.I Riley Petty being first sworn, depose and say that I am the son of George Petty. That the said George Petty was the son of Joseph N. Petty deceased. That the said Joseph N. Petty was the person to whom United States issued a patent which said patent was dated June 14th 1877 and recorded on page 364 of Vol L. of Record of Deeds fro Lane Co., OR and which said patent conveyed to said Joseph N. Petty and wife Martha M. Petty, Donation Land Claim # 48 Notiff. No 6576.
That the said Joseph N. Petty died in January 1875 intestate, that he left children and grandchildren as follows: Geo. Petty, Maria Matthews, John Petty, Joseph Petty, Lorinda Luce, Clara Petty and Ira Petty. That the same Ira Petty on March 27th 1883 and on Jan 22 1883 was unmarrid.
That the above were the only living children of said Joseph N. Petty living at the time of his death. That said Joseph N. Petty had one child, Lucinda Cook, who died prior to the death of said Joseph N. Petty. That the said Lucinda Cook left three minor children, Wm. Walter Cook, Joseph Milton Cook, Ruth Ann Cook, all of whom were living att he time of the death of said Joseph N. Petty.
That the above children and grandchildren were the only children and grandchildren of the said Joseph W. Petty, deceased.
That the said Martha M. Petty and Joseph N. Petty had children as folllows: Clara Petty, Lorinda Luce, John Petty, Joseph Petty and Ira Petty. That the last 5 children were the only children if the bodies of the said Joseph N. Petty and Martha M. Petty.
That the aforesaid George Petty, Maria Matthews and Lucinda Cook were children of said Joseph N. Petty by a former wife.
That the said Martha M. Petty had one child besides the five chilren aforesaid, set forth as being the children of herself and the name of said child was Roena Nicols, and sometimes spelled Rowena Nichols. That the six Children were th only children of said Martha M. Petty. That Clara Petty aforesaid became marriage Clara Saylor; That aforesaid Joseph Petty, whose full name was Joseph N. Petty was unmarried on Oct. 5th 1878.
That the aforesaid Maria Mathews died after the death of the said Joseph N. Petty; that the said Maria Matthews left three children all of whom at the time of her death were minor children; their names are as follows:-Mary L.A. Matthews, Joseph N. Matthews, and William Matthews. That the said Mary L.A. Matthews has since married and her name is now Mary L.A. McQueen.
