An Elizabeth Hood died in Jones County, Georgia, leaving a will dated August 24, 1817 and probated November 03, 1817. She names her sons William and Zachariah Petty, and daughters, Winnie Divisdale and Lucretia Burton. Earlier documents found in Kershaw County, South Carolina show that Elizabeth Hood was the widow of the Revolutionary War Veteran, Luke Petty (1736-1770) who lost an arm in the war. There are also land records which show Elizabeth Hood and Zachariah Petty sold some land in Kershaw County, South Carolina. This may well be Zachariah's portion of his father's estate for Elizabeth left him only $5 in her will.

Application Abstract

Richard Clinton, #S 2113

"...Richard Clinton while a resident of Camden, South Carolina enlisted in the
spring of 1779 and served as a private three months in Captain McKorkle's
Company, Colonel Marshall's South Carolina Regiment.
He served six months under Captain Petty and Major Dane, the date of enlistment
not stated, during which service he lost his finger in a skirmish while en route
from Camden to General Sumter's headquarters in Waxhaws.
He was allowed pension on his application executed December 10, 1834 while a
resident of Davidson County, Tennessee aged seventy-seven years. There is no
data on file as to his family.

The above noted is the only soldier of that name found on the Revolutionary War
records of this Bureau. Respectfully, Commissioner"

Luke was a Captain and lost an arm in the war.

Note: Elizabeth Hood’s will written and probated at Jones County, Georgia in 1817 mentions her son William along with siblings Zachariah, Winney Dinsdale, and Lucretia Burton (Jones County Georgia Will Book A 1809-1864).
Notes from researcher:

Luke is first mentioned in his father’s will as having moved to Carolina by 1770.

Luke married Elizabeth Hood and owned property in Kershaw (Craven) County, South Carolina by obtaining a 200 acre Royal Land Memorial in 1768 (Holcomb, 1999; Royal Grants Volume 18, pg. 338; Memorials Volume 8, pg. 504).

Luke is mentioned as a customer in the 1776-1778 ledger at a trading post the Claremont on the eastside of the Wateree River (Inabinet, 2000).

Luke served in a pool of jurors in 1778-1779. Kershaw Co SC

Luke and wife Elizabeth bought several tracts of land in Camden (Kershaw) County, South Carolina.

Rev War in the south: Luke was a captain in the local militia under the command of Col. Joseph Kershaw (Moss 1983). He was a boone officer who provided a wagon for hire, supplied provisions for both men and horses, as did his wife Elizabeth Hood (Ervin, 1949). Luke lost an arm in the Battle of Wateree in 1780, had his house burned, and title deed papers destroyed by the British.

Both Elizabeth and Luke’s Estate received pensions for their role in the Revolutionary War (Revill, 1969; Accounts Audit, Frame 450-457; Accounts Audit, Frame 439-443).

Luke’s Estate was paid on May 11, 1785; 28 pounds, 14 shillings, 4.5 pennies and 2 pounds, 2 pennies, annual interest for his war accomplishments (Salley, 1915;Accounts Audit, Frame 450-457).

Luke made out a will in October 1781 leaving his wife one third and his children two thirds of his “hole Astete” (Holcomb and Parker, 1978;WPA, Reel 14). Luke probably died about 1782 but his widow Elizabeth Hood lived on, migrating with her children and neighbors to Jones County, Georgia between 1801-1810.

I Thomas Petty of Pittsylvania Co, Va, being of sound mind and disposing memory do make and ordain this to be my last will and testement in mannerand form following to wit:
1st - I desire that all my just debts be paid and funeral expenses shallbe paid by my executor hereafter named, out of any money I may have orhad arising from the sale of a suffcency of my personal property for thatpurpose.
2nd - The balance of my personal property after the payment of my justdebts and funeral expenses, I give to my wife Martha M. Petty during herlife and at her death what remains therefor I give to my children JoelPetty, Eliza Petty, Catherine Petty and Laura Petty to them and theirheirs forever. It is my desire that if at anytime it should be necessarythat my wife should sell any portion of the personally herein bequeathfor her support and that of her children she shall have perfect right todo so.
3rd - The lot of land I live containing Three Acres more or less, Ihereby give to my wife Martha M. Petty during her natural life and at herdeath the some of the proceeds thereof I give to my children Joel Petty,Eliza Petty, Catherine Petty and Laura Petty to them and their heirsforever.
4th - I request of all my children to whom I have heretofore given landby deed to allow the land so deeded to them to be thrown into hotchpot,the same to be valued and divided equally between my children LucretiaLovelace, Mollie J. Hardwick. Henry T. Petty, Pattie M. Boyd, Fannie R.Edwards, William A. Petty, Joel D. Petty, Eliza H. Petty, Catherine L.Petty, Laura M. Petty, and if so thrown into hotchpot I desire that thesaid land shall be equally divided as to value and distribution betweenmy children above named and to their heirs forever. It is further mydesire that in the division of the land afore said that each of mychildren who are now settled on the same shall if they wish retain theirpresent homestead provided an equal division can be affected and allowthem to do so.
5th - I hereby constitute and appoint my wife Martha M. Petty as theexecutor of my estate and revolking all former will or wills by meheretofore made and I desire the court whenever this will is presentedfor probate not to require security of my said executor as I have fullconfidence in her. Given under my hand this 24th day of April 1874.

Having heretofore deeded to my brother John Petty a certain tract of landcontaining One Hundred acres which land was intended for my son WilliamPetty, but since the death of my said brother it is doubtful weather thetitle of said land will be restored to me or my heirs, and in the case itshall not be restored and my other children refuse to go into hotchpot mysaid son William will be deprived of any share of my estate. In thatevent I desire that at the death of my wife Martha M. the Three acres andappuntenances together with the personally given in the body of my willto my four children Joel, Eliza, Catherine and Laura be equally dividedbetween the above named four children and my son William. But in case thesaid land deeded to my brother John shall be restored to me or my heirsand my other children shall consent to the hotchpot then the said land sodeeded to my brother John shall also be thrown into hotchpot and thewhole except the Three acres given to my wife for life and then to myfour younger children be equally divided as fore said, otherwise thetitle of said One Hundred acres of land shall remain with and bequestedin my said son William and his heirs forever.

Coles Jr., one of the subcribing witness thereto to have beenexecuted according to law and is ordered that said will and codical berecorded, and on the motion of Martha M. Petty, the executive who madeoath and entered into and acknowledged a bond in the penalty of twothousand dollars. Conditioned according to law certificate is granted herfor probate of said will and codical in due from the testator requestingthe court not to require security of said executive.
