Larry Rogers (larrymr13 (at) earthlink.net). This John Petty was a Capt. and was the son of Benjamin and Cynthia, but he was born in Wilkes County, and was in the 37th Regiment, enlisted in Wilkes County. The John Petty who married Catherine Osborne was born in Surry County, he was a member of the 34th regiment, enlisted in Ashe County. I believe the part of Surry the family lived in became Yadkin County just before he moved to Ashe/Alleghany. Alleghany was formed from Ashe in 1859. John's death certificate says his dad was Jack, but as you know, that is a name used for many others, such as Dick for Richard. All records I have found lead me to believe his dad was Elisha and his mom, Mary. This family is found in Surry County in 1850. The same family is in Wilkes in 1860 but with dad being called John. I have found many times on these census records, they would put their first name some years and middle or nicknames others. But one of the sons Milas, from this family enlisted in the service in Yadkin County. Mary was living with John and Catherine in one census year. Jack and Mary are buried in Alleghany County on John's former property with Jacks date reading 4/2/1818-5/6/1894, no dates were put on Mary's stone. All children of John and Catherine were born in Alleghany County. I do believe it's possible that these two Johns were related but have been unable to connect them so far.John and Catherine also gave different ages every census year that never added up the same. I'm not sure if they were playing with the census takers or if they really weren't sure exactly how old they were, records do state they could not read or write. There is an article on them and pictures of them in the Alleghany County Heritage Book.
I am looking for any information to clear things up but have been unable so far. I will let you know if I find anything more. I do not know where Capt. John Petty lived after the war as I have not done a search for him yet but do have records stating his middle initial was B.
