Petition of Elias L. Petty showeth to the State of Georgia that on the 27th of April 1881, Elijah Petty of said County, departed this life owning and estate of real and personal property of some value, having prior to this time made his will appointing, Daniel W. Petty his executor, said Daniel W. Petty has refused to act and as your petitoiner agree to accept the Executorship and probate the will which paper annexed to his petition alleges to be Elijah Petty's will duly executed; Therfore your petitoner prays it may be admitted ot record. Your petitioner showeth to the court that W. D. Petty, Elias S. Petty of the county of Murray, in the State of Georgia and John F. Petty , Daniel W. Petty, Nancy C. Murray, Mary walkr, Sarah E. Petty ; Letty J. woody, ; Lotty Petty, Emily Petty and Cynthia Petty of the County Fannin and the State of Georgia are the legatees in said will, your petitioners ever prays, August 1, 1881.

Will:
In the name of God, Amen. the tenth day of May in the year of our lord, one thousand Eight hundred and seventy-nine, I Elijah Petty of he County of Fannnin and the state of Georgia, being trough the blessing of God in a sound state of mind and memory, but calleing to mind the frail tenure of life and that it is appointed to all men once to died, so make and ordain this my last will and tesament that is to say principally and first of all I recommend my soal into the hands of the all mighty god who gave it to me, and the disposal of my body I leave to the entire discreation of my friends. His estate to.
1st to my beloved son John Franklin (Petty) all of my land lying on the west side of Big Skeinah Creek # 244 in 7 Dist. and 1st section of said county and state, valued at $500.

2nd; I give to my dearly beloved wife Sara the balance of the above lot of land.. my grain, farming tools, houses, household and kitchen furniture, & blacksmith tools, and as much of my stock as she needs. & the balance to be equally divided among my chldren.(not named).
At the death of my sife Sarah all of my real and personal estate to be sold and equally divided with my children taking into consideration what each child has had to make each one equal.
He then appointed his son Daniel M. Petty executor. signed Elijah Petty.
