The following is a partial extract from Deed Book L, page 105, of Chatham Co., NC. Dated: Sept. 15, 1800.
”James Brownlow, son of William Brownlow, dec’d; Willis Dillard and Sarah, his wife; Ambrose Petty and Mary, his wife, all of Chatham County, and Samuel Perviance(?) and Mary, his wife of Cumberland Co., NC to: Bartholomew Lightfoot and Zachariah Harmon, of Chatham Co., NC Lot #30 in the town of Pittsboro, which descended to James Brownlow, Sarah Dillard, Mary Petty, as heirs of Jane Patterson, dec’d wife of James Patterson, dec’d with all houses, etc.”

"Lands For Sale"
Three hundred and seventeen acres, well adapted to the culture of tobacco & all kinds of small grain, lying within five miles of the University; eighty acres are now under cultivation and very little injured by use-Good orchards of both apple and peach trees. The purchaser may be accommodated with the crop of corn now growing on the land, together with the stock of cattle, hogs, & sheep. As I am desirous of moving this fall to the State of Tennessee, I am determined to sell on the most reasonable terms.

The country now embraced in Cannon County was settled as early as 1807 and 1809, though it then belonged to several other counties in part. The early settlers were chiefly North Carolinians, who, however, came here from East Tennessee, to which section they had previously immigrated in quest of homes, but pushed on over the mountains as Middle Tennessee opened up for settlement.

The above Ambrose Petty, as the son of Ambrose Petty (the son of James and Martha Petty) is only conjecture by me. I believe this to be right, but it is not proven. Also, I believe that the wife may be Mary Barton, a sister to Bailey Barton. Known fact is that David Mosley was married to Eliza Barton, sister to Bailey Barton.

Personally appeared before me Gabriel Petty who being duly sworn on the Holy Evangelist of God doth make oath and says that he saw Absalom Petty sign, publish, pronounce, and deliverd the annexed instument of writing to be said contains his last will and testament that he the said Absalom Petty was then of sound and disposing mind and memory and understanding to the best of the deponent knowledge and belief and that John Duborrow and Martha Petty together with the deponent signed their names as witnesses thereto at the request of the testtor in his presents and the presence of each other. Molly Petty at the same time qualified as executrix.

The property location on Abington Creek. This was property that James Petty Jr. owned. This property was located next to Joshua's land, and more important, the land of John Jeffries. John Jeffries was the son of Nathaniel Jeffries and Rebecca Curry. Rebecca Curry, was the daughter of Nicholas Curry, one of the executors of the elder James Petty estate.

"After the defeat of the Cherokee nation [defeat 10-1776, treaty 5-1777], there was a peace on the western frontier of South Carolina. “Among [the new immigrants] was John Nuckolls Sr., who left his farm in Dinwiddie County, Virginia, in 1776 and took up lands along Thicketty Creek in Spartan District. There he built his house on a rise overlooking rich bottomland. Zechariah Bullock, Nuckolls’s brother-in-law, followed him to South Carolina. On the east side of the Pacolet River, about four or five miles upstream from Grindal Shoals, Bullock found a site for his new farm."

Note from Jason Petty: In 1807, Thomas Petty moved his family from Union Co., SC to Dickson Co/Hickman Co., TN, where he lived for the next 28 years. In 1836, he moved to the Benton/Humphreys Co. TN area. One of his sons, R.C. Petty, was sheriff of Benton Co. One story handed down by the R.C. Petty family and confirmed by the Journal of Wilford Woodruff, early Mormon Missionary in Western TN and magistrate court records of Benton Co., concerns the arrest of two Elders of the Mormon Church for preaching their doctrine. R.C. brought them to his home rather than leave them in jail. Here they preached the Gospel to the family and Thomas Petty was converted and baptized. R.C. was baptized on April 4, 1844 in this church. He moved his family to Council Point, Iowa, shortly after this. Thomas Petty died in 1843 in Benton County and his wife, Jane Darwin Petty died in 1844. Thought that was an interesting story.

R. C. and John M. were in Benton Co. but migrated. R. C. treked to Utah and died on a missionary trip to OK. There is a diary documenting his illness and death. John M. Petty is on the 1836 and 1840 census in Benton Co TN. He went back to Dickson Co after Thomas died, and made the trip from Dickson Co to Texas in 1848. I'm pretty sure he was one of the "seven brothers and cousins" on the long oxen train. John M. Petty stopped off in Upshur Co. and was there on the 1850 and 1860 census. I haven't looked for his burial--it must be unknown as his family has not posted that. I was reading Upshur cemeteries but I think I was looking for one of John's sons. And I was looking for one of John A. and Betsy (Dawson) Petty's daughters that remarried and moved to Upshur Co and died there.

9Military Record.
Thomas Petty served in the Rev. War and received a pension.
The County Courthouse in Benton Co TN has a prominent plaque on the wall near the front door which lists Thomas with other Benton County residents as heros from the Rev. War.

Various books on Dickson Co history also refer to his service. I have this note from one, "Am Rev. soldies know to have lived in Dickson Co: Thomas Petty (Col Brandon’s Regiment)"

Have have several accounts of his pension application:

Thomas Petty – Private, Capt Montgomery’s Co, South Carolina Militia.
Thomas Petty, age 68, a resident of Dickson Co., Tennessee, applied for a pension in said county on April 3rd, 1833.
Thomas Petty stated that he was born Mar. 31, 1765, in Virginia, and was taken by his parents in his infancy to Bute Co., N.C. He said that his information came from his father’s family records, which he copied into his family record. That his parents removed afterwards to Union County, in the State of South Carolina. He first entered the service as a drafted militia man for a tour of 3 months, and was placed in Capt. Robet Montgonery’s Comp., in Union County, under Henderson, and went to the siege of 96 where they remained until the British received reinforcements. He next entered the service as a volunteer in Captain Crawford’s Co., and Richard Sayer’s Regiment. Following that service he was again drafterd into Montgomery’s unit and marched to Orangeburgh, S.C., where he foutht in the losing cause for that city. Next he served under Capt. Arrington in an expedition into the Indian Nation where they fought and killed several Indians.
After the war, Thomas remained in Union County, until 1807, when he and his family removed to Dickson County, Tennessee.

At the suggestion of Thomas' family, I have taken the name Daniel off of his name until someone can find some kind of documentation that he had "Daniel" or "D." as his middle name.

Petty Papers that Thomas Petty Jr. died before his father made his will in 1841. Also see John Petty's analysis below of other records that the Thomas Petty in Henderson was from a different family.

" I rechecked the 1840 census of Hickman County, Tennessee for Terry Petty. I had seen the name but had not really evaluated it in comparison with the 1850 census. In 1840 Terry Petty was represented as a 50 year old widow! The statistics for the children matched the entry for Thomas D. Petty of Henderson County that same year, minus the youngest son and youngest daughters. Terry Petty was not the father of William K, and Jacob H. Petty, Terry was their mother!
Apparently Thomas Petty Jr. died in 1840 in Henderson County. And perhaps his youngest son and youngest daughters also died at the same time. Following their deaths Terry and the rest of the family returned to Hickman County where her other children lived."

"In the name of God amen. I, Thomas Petty, of this the County of Benton and State of Tennessee, being at this time in ------- state of health but of perfect mind and memory do make and ordain this my last will and testament in manner and form following (to wit) Imprimis my will and desire is that all my just debts be paid off by my executors here in after named immediately (or as soon as arrangements can be made there for after my decease. Item 1st I give and bequeath to my beloved wife Jane Petty the whole of my estate both real and personal that I may be possessed of after my debts as aforesaid being paid off to be possessed and enjoyed by her during her natural life and at her decease my will is that my son, George V. Petty, my daughter, Polly D (?) Wright, my son, Robert C. Petty and my daughter, Kizia A Whitehorn do each receive as ------ one third more that they would otherwise receive upon an equal division of the whole and that my three other sons (to wit) James D. Petty, Ambrose R. Petty and John M. Petty do each receive an equal portion of the ---------- to all of them or their heirs. Lastly I hereby constitute and appoint John M. Petty and Robert C. Petty executors of this my last will and testament[- ---I cannot read the rest as the paper is blurred. It is about 3 lines]. Record of Wills In witness where of I have hereunto set my hand and affixed my seal this first day of July one thousand eight hundred and forty one ---------- therefore assigned. his Signed, sealed and published by the said Thomas X Petty Thomas Petty to be his last will and mark Testament in presence of us James Williams E. The notation on the margin of the copy of the will - I can read only part of it as a hole was punched in it - says Will of Thomas Petty, July 1, 1841, Benton Co. TN- Misc Records Book- then the hole must be where the book # was- then 655 - that must be the page number.

Petty is my (Sharolyn) gg grandfather. The Geo. W. is most probably son George Valentine Petty. A. Lashee would be the husband of Elizabeth Petty, daughter of George & Lydia (Harrington) Petty, who lived in Benton Co.}

" It is evident that the land in Union Co. (now Cherokee Co.) belonging to Thomas Petty’s father, James Petty Sr., was bordering the land of James Darwin in York Co., SC, because several in both families intermarried. After Jane Darwin’s marriage to Thomas, they remained in South Carolina, where their first five children were born though it is not clear as to whether they resided in York Co. or Union Co. and in 1807 the family departed for Tennessee. On the 11 Jan. 1808, Thomas bought 1051 acres in Hickman Co., TN, on both sides of the Piney River from Robert Weakley and this deed was registered on 23 July 1808:

THIS INDENTURE made this eleventh day of January one thousand eight hundred and eight between Robert Weakley of Davidson County and State of Tennessee of the one part and Thomas Petty of Hickman County and State aforesaid of the other part Witnesseth that for the consideration of the sum of one thousand and fifty one dollars to him the said Robert Weakley in hand paid by him the said Thomas Petty the receipt whereof he doth by these presents acknowledged, hath bargained, granted, sold, aliened, enffeoffed and confirmed by these presents doth bargain, grant, sell, alien, enffoeff and confirm unto the said Thomas Petty his heirs and assigns forever all that tract or parcel of land situate, lying and being in the County of Hickman and State aforesaid on both sides of Pine River beginning at a poplar in a hollow sixty chains west of Pine River, the original south west corner of the tract of which this is part and runs north eighty seven chains sixty links to a stake thence east one hundred and twenty chains to a stake thence south eighty seven chains sixty links to a dogwood, thence west one hundred and twenty chains to the beginning containing one thousand and fifty one acres, it being the one half of a military grant of 2102 acres granted by patent from the State of North Carolina to a certain Aron Lambert and by the said Lambert conveyed by deed into the above named Robert Weakley bearing the date December the fifteenth day one thousand seven hundred and ninety five which deed is accorded in the Registers Office of Montgomery County and State of Tennessee. To have and to hold the aforesaid tract or parcel of land with all advantages hereditaments and appertenances thereunto belonging or in any wise appertaining unto the said Thomas Petty his heirs and assigns forever and the said Robert Weakley for himself his heirs executors and administrators doth covenant and agree to and with the said Thomas Petty his heirs and assigns to warrant and forever defend the aforesaid bargained premises unto the said Thomas Petty his heirs and assigns against the claim or demand of all and every person or persons whatsoever. April Session 1808 then was the execution of the written deed on conveyance Robert Weakley to Thomas Petty for 1051 acres proved by the oaths of Bartlet G. Stewart and Thomas Petty Jr. and ordered to be registered.

It is believed that Jane’s brother, James Darwin Jr., joined up with Thomas and Jane around 1812 as a state grant for 40 acres in Hickman Co. was given to him on 2 Aug. 1813 and mentions his “improvements” which meant he had certainly lived on it for a while at least. In 1814 Thomas Petty bought at a sheriff’s auction, as highest bidder, this 40 acres, which was condemned to satisfy a judgement against James Darwin Jr. There is no further reference to James Darwin Jr. in Tennessee.

THIS INDENTURE made this twenty third day of April in the year of our Lord one thousand eight hundred and seventeen between William Phillip, sheriff of Hickman County in the State of Tennessee of the one part and Thomas Petty Senior, of the other part:
WITNESSETH: That whereas to-wit at October Term, eighteen hundred and thirteen James Garden obtained a judgement against James Darwin for twelve dollars and costs of suit on exactment on which an order of sale, issued to sell forty acres of land belonging to said Darwin or so much thereof as would satisfy said judgement and said forty acres being amortised as the law directs to be sold at the court house at Vernon on the fifteenth day of January one thousand eight hundred and fourteen at which time the said forty acres was sold to Thomas Petty, Sr. for ten dollars fifty cents, he being the last and best bidder that for and in consideration of the said sum of ten dollars fifty cents to the said William Phillips, sheriff as aforesaid in hand paid by said Thomas Petty the receipt whereof is hereby acknowledged hath given, granted, bargained, sold, aliened, conveyed and confirmed unto said Thomas Petty, Sr. his heirs and assigns forever the before mentioned forty acres of land situate, lying and being in the County of Hickman lying on the east side of the Pine River in the first district on a double branch of said river. Beginning at a beech marked B.S. on the north side of said branch running east one hundred poles crossing the branch at about four poles to a white walnut thence south sixty four poles to a white oak; thence west one hundred poles to a beech and hickory; thence north sixty four poles crossing the branch to the beginning including said Darwins improvements containing the before mentioned forty acres.
TO HAVE AND TO HOLD the aforesaid land with all and singular, the rights, profits, emoluments, hereditaments, and appurtenances of in and to the same belonging or in anywise appertaining to the only proper use and behoof of him the said Thomas Petty, his heirs and assigns forever and the said William Phillips, Sheriff as aforesaid for himself, his executors and administrators doth covenant and agree to and with the said Thomas Petty, his heirs and assigns that the before recited land and bargained premises he will warrant and defend as far fourth as authorized by virtue of his office and no further against the right, title, interest and claim of all and every person or persons.

The within deed was exhibited in open court and the execution thereof acknowledged by William Phillips, sheriff of Hickman County to be his act and deed ordered to be certified for registration.

The Petty Papers note that Thomas Petty’s estate amounted to 1200 acres in both Dickson and Hickman Co. in a part of Tennessee where the land was very fertile. The 1820 census for Dickson Co. shows that Thomas had ten slaves, six males and four females, who worked alongside the family in the planting and harvesting the crops. It was also in 1820 that James sold half of his original holding of 1051 acres to Gabriel Petty and two years later followed up this transaction with a further 40 acres to his brother from the James Darwin, Jr., tract (see section 3.15 Sarah Darwin). A year later in 1823, he sold another 100 acres of his original holding to his son James D. Petty. Finally, he sold the last of his land in Dickson Co. to his son James D. Petty by the beginning of April 1834 in preparation for a move westward to Benton Co., TN, in 1835 at which time he was 70 years old. The travel party consisted of himself, his wife Jane and youngest daughter Keziah along with the families of his sons John and Robert Cowan Petty. He lived the remainder of his life at his new home in Benton Co. and died in 1841 at the age of 76. In his will he named his sons James D. Petty, Ambrose R. Petty, George V. Petty, John M. Petty, and Robert C. Petty; and also his two daughters Polly D. Wright, and Keziah A. Whitehorn. Sons John M. Petty and Robert C. Petty were appointed executors of the estate. After the sale of the estate on 24 Aug. 1841, several claims for debts were made against Thomas’ estate. These resulted in an order of the court to sell in public auction the slaves of the estate, consisting of a negro woman named Crecy, age 27, a girl named Susan, age 10, a girl named Harriet, age 6, a girl named Caroline, age 3, and a boy named George, age 2. When the sale occurred, Robert Cowan Petty purchased all five so that they could remain with the estate and help care for his widowed mother Jane, who would live another three years until 1844."
